FDA’s Decision Regarding Plan B: Questions and Answers

Using emergency contraception, you can avoid becoming pregnant when a contraceptive technique has failed or after having unprotected intercourse for the first time.It should not be used on a regular basis.Emergency contraceptive pills, post-coital pills, and morning after pills are all terms used to describe medications used for this reason.

When used as an emergency contraceptive, the hormones estrogen and progestin (levonorgestrel) are present, either independently or in combination.Preven (authorized in 1998) and Plan B (approved in 1998) are two emergency contraceptive medicines that have been approved by the FDA for prescription usage (approved in 1999).2.

What is the contingency plan?Plan B is emergency contraception, which serves as a back-up technique for contraception.A total of two levonorgestrel tablets (0.75 mg in total, per pill) are required to be taken by mouth after unprotected intercourse to be effective.It has been almost 35 years since levonorgestrel, a synthetic hormone, has been utilized in birth control tablets.If a woman has had unprotected intercourse, Plan B can help minimize her chances of becoming pregnant if she takes it as prescribed.

Plan B will not function if a fertilized egg is implanted prior to the administration of Plan B.When the FDA considered moving Plan B from a prescription to an over-the-counter (OTC) status, what procedures did they follow?The Food and Drug Administration (FDA) has received an application to change Plan B’s classification from prescription to nonprescription.Among other things, FDA officials looked over the scientific evidence submitted in the application, which included an actual usage study and a label comprehension study, among other things.Our public advisory group met on December 16, 2003, and was comprised of a panel of medical and scientific professionals from outside the federal government who shared their expertise with us.

  1. In a combined meeting with the Advisory Committee on Reproductive Health, members of the Nonprescription Drugs Advisory Committee and the Advisory Committee on Reproductive Health discussed the safety and efficacy evidence pertaining to the nonprescription use of Plan B.
  2. In spite of the fact that the joint committee recommended to the FDA that this product be sold without a prescription, some members of the committee, including the committee’s chair, expressed concerns about whether the actual use data were generalizable to the overall population of nonprescription users, primarily due to insufficient sampling of younger age groups.
  3. Following the meeting of the advisory committee, the FDA sought further information from the sponsor on the usage of the product by adolescents.
  4. The sponsor submitted this new information to the FDA in support of their pending application to convert Plan B from a prescription medication to an over-the-counter product (see below).
  5. This fresh information was significant enough to qualify as a significant modification to the NDA.
  6. Major revisions to the Prescription Drug User Fee Act (PDUFA) performance objectives, such as this one, may result in a 90-day extension of the original PDUFA date under the conditions of the PDUFA performance goals.

Now that the FDA has completed its review of the supplemental application, it has determined that the application cannot be approved at this time because 1) sufficient data were not provided to support a conclusion that young adolescent women can safely use Plan B for emergency contraception without the professional supervision of a licensed practitioner and 2) adequate data were not provided to support a conclusion that young adolescent women can safely use Plan B for emergency contraception without the professional supervision of a licensed practitioner.A suggestion from the sponsor to amend the proposed indication to enable Plan B to be marketed solely by prescription for women under the age of 16 and as a nonprescription medication for women 16 and older was found to be insufficient for a thorough evaluation and was thus not considered.As a result, the FDA determined that the application was not suitable for approval.The FDA failed to heed the advice of its advisory committees, which led to question number 5.The FDA advisory panels’ recommendations are purely advisory in nature, and the Agency is under no obligation to heed their recommendations in any way.The FDA makes a judgment on whether or not a product should be authorized after reviewing all of the evidence and taking into account the suggestions of the advisory committee on the product.

  • Due to the fact that the additional application did not establish that Plan B could be used safely by young teenage women for emergency contraception without the professional supervision of an appropriately registered practitioner, the FDA issued a Not Approvable letter.

In this case, the applicant would be required to either provide additional data demonstrating that Plan B can be used safely by women under the age of 16 without the professional supervision of a practitioner licensed by law to administer the drug or provide additional support for the revised indication, which would allow Plan B to be marketed as a prescription-only medication for women under the age of 16 and as a nonprescription medication for women 16 years of age and older in this situation.

  4. Was there a difference of opinion on the final judgment within the Centers for Drug Evaluation and Research (CDER) and within the FDA?
